Medical Treatment & Bills

Can I choose my own doctor?

Short Answer
Yes. This isn't workers' compensation — you choose your treating providers.

Yes. In a Florida auto injury claim you select your own doctors. No insurer directs your care.

What insurers can do. Require an independent medical examination under your PIP policy — an evaluation, not treatment. Dispute whether particular treatment was reasonable, related, and necessary. Decline to pay for care they contest.

What they can't do. Choose your treating physician or require you to see someone before getting care.

What to look for in a provider. Someone who documents thoroughly, who will address permanency if that becomes relevant, and who treats crash injuries regularly enough to know what the records need to show.

One caution on referrals. Florida now requires disclosure of whether your attorney referred you to a treating provider, and the defense will examine that relationship. Referrals aren't improper, but they're visible, and a provider who treats primarily on attorney referral will be cross-examined about it.

Your choice — but pick someone who documents well. The records are the case. ---
