What happens if I failed a drug test on probation?

A positive test is a technical violation, which means the alternative sanctioning path may be available depending on eligibility and your circuit's administrative order.

What influences the response: whether it's a first positive, whether you self-reported, whether you're in treatment, what substance, and whether there's a plausible alternative explanation.

On challenging the result. Field tests used in probation settings are screening tools, and confirmatory laboratory testing is a different thing. Where a result matters, asking whether confirmation was performed is worth doing. Prescription medications, and in some cases legal products, can produce results requiring explanation.

On the most useful response. Enrolling in treatment before the hearing rather than after changes the conversation substantially. Courts respond to evidence that the underlying problem is being addressed, and the timing of that enrollment is visible.

Missing a test is generally treated similarly to failing one, and sometimes worse, because it looks like avoidance.
